Terms of Use

These terms are an agreement between you and Mofungo Games ("we", "us") for your use of the Bandwagn app and website ("the service"). By creating an account or using the service you agree to these terms and to our Privacy Policy.

Eligibility and Your Account

• You must be at least 13 years old to use Bandwagn.
• You are responsible for keeping your sign-in details secure and for everything that happens under your account.
• Give accurate information about yourself. Do not impersonate anyone or create an account for someone else.
• One account per person. We may remove duplicate or automated accounts.

Your Content

You own the photos, text, links and other content you add to Bandwagn. By posting it you give us a non-exclusive, worldwide, royalty-free licence to store, display and transmit it so that the service works, for example showing your profile to other users. This licence ends when you delete the content or your account, except where it has already been shared with other users (such as messages you sent).

Only post content you have the right to share. Do not upload images of other people without their permission.

Community Rules

Bandwagn is for finding people to make music with. Do not use it to:

• harass, threaten, demean or discriminate against anyone;
• post sexual, violent, hateful or otherwise objectionable content;
• send spam, advertising or repeated unwanted messages;
• share other people's personal information without consent;
• scrape, copy or collect other users' data, or access the service by automated means;
• break the law or infringe anyone's rights.

You can block any user, and you can report abuse to [email protected].

Meeting People

Bandwagn introduces you to other musicians, but we do not screen users or verify who they are. Use common sense when meeting anyone in person: meet in public places, tell someone where you are going, and trust your instincts. You are responsible for your interactions with other users.

Moderation and Enforcement

We may remove content, limit features, or suspend or terminate accounts that violate these terms or that we reasonably believe are harmful to other users or the service, with or without notice. We are not obliged to monitor content but may do so.

Third-Party Content

Band information, images and similar-artist data come from public sources such as MusicBrainz, Deezer and ListenBrainz, and videos are played through YouTube and Vimeo. We do not control and are not responsible for third-party content or services.

Availability and Changes

Bandwagn is provided as a free service and is currently in testing. We may change, suspend or discontinue any part of it at any time. We will try to give notice of significant changes but cannot guarantee uninterrupted availability.

Termination

You can delete your account at any time from Settings. We may terminate or suspend your access if you breach these terms. Sections that by their nature should survive, including Your Content and Disclaimers and Liability, continue after termination.

Disclaimers and Liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Mofungo Games will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, goodwill or opportunity, arising from your use of the service or your interactions with other users. Our total liability for any claim relating to the service is limited to US $50.

Governing Law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California.

Changes to These Terms

We may update these terms from time to time. Continued use of the service after an update means you accept the new terms. We will update the date at the top of this page.
